Development Applications

The purpose of a Development Application (DA) is to allow the Consent Authority (usually Council), and at times the community, to assess what impacts are likely to occur as a result of the proposal.

In order to assess these impacts supporting information must be submitted with the application. Some of the information is regulated by the Environmental Planning and Assessment Regulation (Schedule 1 Part 1 EPA Regulation 2000) and some is additionally required by Council.

Generally the information required is in the format of both drawn plans and a written statement. The information below has been developed to assist residents who are planning to lodge a Development Application with Council.

Information that must be lodged with a Development Application

  • site analysis plan of the land;  
  • Detailed development plans;
  • statement of environmental effects (in the case of development other than Designated Development);
  • In the case of development that involves the erection of a building, an A4 plan of the building that indicates its height and external configuration, as erected, in relation to its site;
  • Where applicable, a BASIX Certificate and any supporting information referred to in the certificate. More information can be found online at BASIX;
  • An Environmental Impact Statement (in the case of Designated Development); 
  • A Species Impact Statement (in the case of land that is, or is part of, critical habitat or development that is likely to significantly affect threatened species, populations or ecological communities, or their habitats); 
  • If the development involves any subdivision work, preliminary engineering drawings of the work to be carried out; 
  • If an environmental planning instrument requires arrangements for any matter to have been made before development consent may be granted (such as arrangements for the provision of utility services), documentary evidence that such arrangements have been made; 
  • If the development involves a change of use of a building (other than a dwelling house or a building or structure that is ancillary to a dwelling house):
    (i) a list of the Category 1 fire safety provisions that currently apply to the existing building; and
    (ii) a list of the Category 1 fire safety provisions that are to apply to the building following its change of use;
  • If the development involves building work to alter, expand or rebuild an existing building, a scaled plan of the existing building; and 
  • If the land is within a wilderness area and is the subject of a Wilderness Protection Agreement or Conservation Agreement within the meaning of the Wilderness Act 1987, a copy of the consent of the Minister for the Environment to the carrying out of the development.

It is recommended that any resident considering submitting a Development Application with Council should speak with a Building and Development Duty Officer in the first instance.

Site Analysis Plan

A Site Analysis Plan assists the developer and Council to consider both the existing landscape and development on the site, and to gauge the impacts of the proposed development on the site.

The Site Analysis Plan may also need to include neighbouring or near-by development if the proposal is likely to impact on the neighbourhood in any way.
The following should be included, as a minimum, on a Site Analysis Plan:

  • Date, author's name, plan number, scale of plan (1:100, 1:200, 1:500);
  • Location, boundary dimensions, site area and north point;
  • Location and type of existing vegetation;
  • Location and use of buildings; 
  • Existing levels of the land in relation to building and roads (contours/spot levels);
  • The location and use of buildings on adjoining sites;
  • Existing access arrangements;
  • Flood prone areas;
  • Services (phone, power etc); and
  • Contaminated areas and land degradation areas.

The level of detail required may change depending on what type and scale of development is proposed.

Development plans

Development plans detail the actual development as proposed in a graphic form for easier understanding and assessment.
Development Plans should include, as a minimum, the following information:

  • Date, author's name, scale of plan (1:100, 1;200, 1:500), plan number; 
  • Location of any existing or proposed building or works; 
  • Dimensioned floor plans showing layout, room sizes and use; 
  • Dimensioned elevations and section showing external finishes, window and door openings and heights of the proposed buildings; 
  • Finished levels of the land and building in AHD; 
  • Proposed parking, entry and exit points and provision for vehicle movements within the site including dimensions; 
  • Any proposed advertising signs; 
  • Proposed landscaping and treatment of the land indicating plant types and their height and maturity; and 
  • Proposed methods of drainage and servicing.

Statement of Environmental Effects 

To accompany the Site Analysis Plans and Development Plans, a written statement is required to further explain and justify the proposal.

The statement should include, as a minimum, the following information:

  • Description of land and definition of land use proposal (as defined in the relevant LEP); 
  • Demonstrated compliance with all the relevant provisions contained in State Environmental Planning Policies, Local Environmental Plan and Development Control Plan(s) applying to the land/development; 
  • Site suitability for proposed development; 
  • Site constraints (eg flooding, slope, adjoining land uses); 
  • Visual setting (eg character conservation area); 
  • Urban or rural development strategy; 
  • Size and shape of allotments; 
  • Age and condition of buildings; 
  • Present and previous use of the land; 
  • Present use of site and when this use commenced; 
  • Present use of adjoining land; 
  • Statement as to whether the site is contaminated or not; 
  • Any previous contamination investigations carried out on the site; 
  • Operation details; 
  • Hours and days of operation; 
  • Number of staff; 
  • Maximum expected number of customers; 
  • Method of deliveries (loading, unloading); 
  • Expected timing and frequency of deliveries; 
  • Production processes including flow diagram; 
  • Type of waste products; 
  • Any hazardous materials use, storage or processing; 
  • The environmental impacts of the development and how these have been identified; and 
  • Steps taken to prevent the environment impacts or lessen the expected harm.

Pre-lodgement Meetings

A useful method of determining the information required with a Development Application is to have a pre-lodgement meeting.

Note: It is not feasible to provide a comprehensive list of information required with all applications. This is due to the fact that no two sites or developments proposed are the same. For this reason it is strongly recommended that you hold a pre-lodgment meeting with Council officers.
