OUTCOMES OF THE JULY ORDINARY COUNCIL MEETING

Dubbo Regional Council (DRC) met on Thursday 28 July 2022, 5:30pm in the Dubbo Council Chambers with the following outcomes.

NOTICE OF MOTION: DISABILITY ACCESS AND INCLUSION ADVISORY COMMITTEE
Council has requested the Director Community Culture and Places provide to the August 2022 Council meeting a report on a proposed Disability Access and Inclusion Advisory Committee with Councillor representatives, including a draft Terms of Reference to be determined.

FLUORIDATION OF DUBBO URBAN AREAS' WATER SUPPLY
Council has noted a report that outlined that Council has not been fluoridating drinking water in Dubbo since January 2019 due to an infrastructure failure. Full statement online; Fluoridation of Dubbo's Water Supply

UPDATE ON DUBBO NON-POTABLE PIPELINE PROJECT
Council has noted the advice from regulators that approval to utilise treated effluent on playing fields that are directly above an aquifer used for drinking water supply will not be forthcoming. Council requested the CEO provide an update to Council on the possible alternative use of the treated effluent irrigation pipeline.

QUARTERLY REPORT ON CODE OF CONDUCT COMPLAINT STATISTICS FOR APRIL TO JUNE 2022 AND FINANCIAL YEAR SUMMARY
There were no new complaints during this period.

SPECIAL TEMPORARY DELEGATION FOR THE CHIEF EXECUTIVE OFFICER
Council has resolved to grant Chief Executive Officer special delegation to execute any necessary documentation in relation to the sale of land at Keswick Estate stage 5 release 2 on the provision that the reserve price is met or exceeded by the successful buyer. Council also resolved to grant the Director Organisational Performance special delegation to execute any necessary documentation in relation to the sale of land at Keswick Estate stage 5 release 2 as a risk mitigation measure to cover for any unexpected absence or isolation of the CEO.

PAYMENT OF EXPENSES AND PROVISION OF FACILITIES FOR THE MAYOR AND COUNCILLORS
The draft Council Policy, Payment of Expenses and Provision of Facilities for the Mayor and Councillors, as attached at Appendix 1 of the Council report, was adopted for the purpose of public exhibition. Council requested that a further report be submitted to Council detailing results of public exhibition, for adoption of the final policy.

SMART REGION STRATEGY AND SMART COUNCIL STRATEGY
Council has adopted for the purpose of public exhibition the Smart Region Strategy (attached in Appendix 1 of the report) and a Smart Council Strategy (attached in Appendix 2 of the report). Council requested that following completion of public exhibition, a further report be presented to Council for consideration, including the results of the public exhibition.

DRAFT SOCIAL MEDIA POLICY
Council adopted the Draft Social Media Policy, as attached in the report, for the purpose of public exhibition. Council requested a further report be provided to Council.

SOCIAL HOUSING DEVELOPMENT SCHEME - DRAFT PLANNING AGREEMENT
Council noted the current status and discussions with the Proponent of the Forest Glen Solar Farm development in respect to a Voluntary Planning Agreement. Council resolved to have a Voluntary Planning Agreement (VPA) be prepared. Council determined that if a VPA cannot be successfully negotiated with the Proponent that a further report is to be provided for the consideration of Council. The draft Voluntary Planning Agreement to  be placed on public display in accordance with the provisions of the Environmental Planning and Assessment Act 1979.

CONTRACT FOR ELECTRICITY – SMALL SITES
Council resolved to award the “Retail Electricity Supply Agreement - Small Sites” to “Shell Energy Retail Pty Ltd ” in accordance with Local Government Act 1993 Section 55 (3) for the amount of $ 810,500 (Inc. GST) (indicative cost linked to usage). Council noted that 100% Green Power option is to be included in the contract. All documentation in relation to this matter will remain confidential to Council.

LEASE OF LAND – AIRPORT HANGAR SITE 20 TO AIRLINK
Council approved the lease of Hangar Site 20, Dubbo Regional Airport to Airlink Pty Ltd. All legal fees associated with the preparation of the lease be borne by the lessee.

LEASE TO THE CROWN AS PART OF DUBBO AIRPORT PRECINCT FOR REGIONAL POLICE TRAINING FACILITY
Council approved the Crown Lease (in right of the State of NSW represented by the NSW Police Force) over Lot 2 on DP1267927, provided that the lease:

a. discloses PFAS being found within Lot 2 on DP1267927;

B. states that Council will not remediate any PFAS within Lot 2 on DP1267927;

C. allows Council (and its consultants and contractors) entry into the Lot 2 on DP1267927 for further PFAS testing (if necessary), subject to reasonable notice being provided; and

D. contains substantially the same terms as outlined in Appendix 1 of this report.

All documentation in relation to this matter remain confidential to Council.

TENDER FOR THE SUPPLY AND INSTALLATION OF LANDSCAPING – KESWICK ESTATE – STAGE 5 RELEASE 1
Council resolved to award the tender for the supply and installation of landscaping for Keswick Stage 5 Release 1, to Mark Wright Premier Landscapes in accordance with s55 of the Local Government Act 1993 for the amount of $476,393.00 (including GST).

EXPLORING OPTIONS FOR THE NSW DESTINATION CHARGING GRANT
Council selected a preferred site/s and resolved to apply to the first round of the NSW Government’s Drive electric NSW EV Destination Charging Grant by September 2022. Council noted that financial contributions required by Council have not been budgeted for, that funds be identified in the September 2022 quarterly review to be allocated to the project.

TENDER FOR THE DESIGN AND CONSTRUCTION ON BENOLONG ROAD BRIDGE
Council resolved that the contract for the Design and Construction of the Benolong Road Bridge be awarded to Murray Constructions Pty Ltd, in accordance with Clause 178 (3) of the Local Government (General) Regulation 2021 for the amount of $2,179,417.90 (Including GST).
